Sentient is an AI-powered receptionist platform that helps you manage email, SMS, and phone calls. It provides AI-drafted replies, lead scoring, and automated routing. The Service includes web and API access as described in your plan.

3. Account and Eligibility

You must be at least 16 years old and legally able to enter into a contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe on the intellectual property, privacy, or other rights of third parties.
• Send spam, phishing, or malicious content.
• Abuse or overload our systems or third-party integrations.
• Attempt to gain unauthorized access to our systems or other accounts.
• Use the Service for fraudulent or deceptive purposes.

We may suspend or terminate your account if we reasonably believe you have violated these Terms or engaged in abusive conduct.

5. Subscriptions and Payment

Paid plans are billed according to the pricing displayed at signup. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Fees are non-refundable except as required by law or as stated in our refund policy. We may change prices with notice; continued use after the change constitutes acceptance.

6. Third-Party Services

The Service integrates with third-party providers (e.g., Google, Microsoft, Twilio). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their availability.

7. Intellectual Property

The Service, including software, design, and content, is owned by Sentient and its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription. You retain ownership of your data; you grant us a license to use it as needed to provide the Service and as described in our Privacy Policy.

8. AI Output and Accuracy

The Service uses AI to generate draft replies and other content. AI outputs may be inaccurate or inappropriate. You are responsible for reviewing and approving content before it is sent. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENTIENT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Sentient and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may cancel your account at any time. We may suspend or terminate your account for breach of these Terms, non-payment, or at our discretion. Upon termination, your right to use the Service ceases. We may retain your data as described in our Privacy Policy.

13. Modifications

We may modify these Terms from time to time. We will post the updated Terms on this page and, for material changes, notify you by email or through the Service. Your continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service.

14. General

These Terms constitute the entire agreement between you and Sentient regarding the Service. Any failure to enforce a provision does not waive that provision. If any part of these Terms is invalid, the remaining parts remain in effect. These Terms are governed by the laws of the United States, without regard to conflict of law principles.
